In the FREE PLAN , you agree to provide your email and register on the platform. Free registration is limited to one account per person/entity - more than one registration per person/entity is not allowed.
In the paid plan, the CONSENTED AUTOMATIC RENEWAL : All paid plans on credit card constitute a renewable subscription contract monthly, or for the contracted period, for an indefinite period, with MONTHLY CHARGES carried out automatically on the indicated credit card, until cancellation occurs by the user themselves - situation in which all future charges will cease and the user will lose access to the platform. Paid registration (PREMIUM) is limited to one account per person/entity - more than one registration per person/entity is not allowed.
You can CANCEL THE SUBSCRIPTION at any time, without any additional cost or loyalty. Cancellation must be done by the user themselves through the "My Account" menu.
You CANNOT download, store, resell, disclose, distribute or publish even for free the content of this platform for any purpose unless explicitly permitted by the author. It is not allowed to download or store the platform's content simply for future use, without written consent from the author.
LGPD: We use cookies and other technologies to improve the user experience, and we may capture, store and process your personal information. You have the right to access, request deletion or confirm that we process your personal data, except when legal or tax obligations prevent us from doing so. You also have the right to contact the Brazilian Data Protection Authority directly.
Compulsory cancellation. We reserve the right to carry out the immediate cancellation or blocking without prior notice of your account (or accesses linked directly or indirectly to you), whether paid or free, if you do not comply with any of the clauses present in these terms. We may block access and request additional information from users if we identify suspicious activities or usage patterns outside the expected for the proposal of this tool.
Any difficulty, impediment, request, suggestion or complaint can be made through the platform's COMMUNICATION channel, clicking on CONTACT in the site footer.

PLATFORM TERMS OF USE

Welcome to D-Fit! We thank you for using our content sharing platform. By using the platform, you are agreeing to these terms. Read them carefully.

HOW TO USE OUR SERVICES

You must follow the policies made available to you within the D-Fit. Do not misuse our Services. For example, do not interfere with our Services or try to access them using a method other than the interface and instructions we provide. You can use our services only as permitted by law, including applicable export and re-export control regulations. We may suspend or stop providing our Services if you violate our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. These terms do not grant you the right to use any trademarks, content or logos used in our Services. Do not remove, obscure or alter any legal notices displayed in or along with our Services. Our Services display some content that is not created or provided by D-Fit. Such content is the sole responsibility of the entity and users who provide it. We may review content to determine if it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean we will review all content, so please do not assume that we do, and no responsibility falls on D-Fit for the content shared.

In connection with your use of the Services, we may send you service announcements, administrative messages and other information. You may opt out of these communications at any time. Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you or prevents you from complying with traffic or safety laws.

YOUR ACCOUNT

To use any of our Services you need to create an Account by registering an account on the platform, being necessary to provide, among other data, email address and personal and non-transferable password. The registration authorizes the sending of platform updates.

The USER is solely responsible, for all purposes, for the operations carried out on their account. To protect your Account, the user must keep the password secret or logout after each session. The activity carried out on the Account or through it is the responsibility of the user. We do not recommend reusing the Account password in third-party applications or public computers. If you become aware of unauthorized use of your password or Account, the user must notify D-Fit for immediate cancellation.

CONSENTED AUTOMATIC RENEWAL

For total user convenience, the subscription made through the credit card constitutes a monthly renewable subscription contract, or for the contracted period, for an indefinite period , with MONTHLY CHARGES carried out automatically on the indicated credit card, until cancellation occurs by the user themselves - situation in which all future charges will cease and the user will lose access to the platform. The subscription is managed by the STRIPE company, where their terms of service and privacy policy MUST also be verified and accepted by the user.

By using our Services, you agree to respect our privacy policies. We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers. We provide information to help copyright owners manage their intellectual property online. If you believe someone is violating your copyrights and want to notify us, you can send a contact .

CONTENT IN OUR SERVICES - AUTHORIAL LICENSE

Some of our Services allow you to upload, submit, store, send, publish or receive content. When you upload, submit, store, send, publish or receive content to our Services or through them, you grant D-Fit (and those we work with) a worldwide license without royalty rights to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content better fits users' needs), communicate, publish, perform and publicly display and distribute such content.

This license allows the commercial use of your content by D-Fit to attract users, which may result in financial benefits to D-Fit through advertising, subscription sales, charging for specific features such as viewing or downloading your content in different formats, among other forms of remuneration that D-Fit deems appropriate, without you having any right to remuneration, and persists even if you stop using our Services. Some Services may offer you ways to access and remove content that has been provided to that Service. In addition, in some of our Services, there are terms or settings that restrict the scope of our use of the content submitted in those Services.

Make sure you have the necessary rights to grant us the license for any content you submit to our Services. By making your content available you expressly agree to the broad disclosure and use by D-Fit users, without any financial consideration, granting D-Fit a perpetual, unrestricted and irrevocable license, with international validity, royalty-free to use, distribute, display, modify, edit, perform, sell, reproduce, publish, adapt, translate and create other derivative texts from your content in any type and format, media or technology. In this regard, it is up to the account holder to register their personal data correctly, especially to declare that the content made available is of their Authorship, remaining entirely responsible for plagiarism actions and complaints. The information eventually available on D-Fit is automatically extracted from various internet sources or is published on D-Fit by its users, who do not maintain any kind of link with the platform.

PLATFORM OPERATION

D-Fit will not be responsible under any circumstances for any interruptions caused by the hosting service of the site or maintenance, power outages or communication system failures, force majeure or acts of God.

USE OF THIS CONTENT

All content made available on D-Fit must be used for personal learning or teaching, and it is expressly PROHIBITED to reproduce or store the content of this page in any communication medium, electronic or printed, without written authorization from the author, including the site's images.

USAGE RESTRICTIONS

Who can use the platform. All access to the contents of this platform must be made exclusively by real people, whether free or paid. Access to content by robots or any other automated or semi-automated method is prohibited. Access to the platform through anonymous VPNs or from sources not consistent with human activity (e.g., data-centers, etc.) is prohibited. Only one registration is allowed per natural person or entity.

Accounts with duplicate accounts belonging to the same person, use of false or incomplete data, use of third parties, use of VPNs, content or ad blockers, plugins that alter the basic functionalities of the platform, behaviors or accesses from sources outside the normal human pattern, or with mechanized accesses, will be suspended, which may result in exclusion and banning of the user from the platform.

User identification. Each registered natural person must uniquely identify themselves using:

Their true full name and correct date of birth, as registered in their CPF.
A valid personal email. Temporary emails created for the specific purpose of registering on the site or for non-personal use will not be accepted under any circumstances. Emails from domains whose ownership is not identifiable or whose site does not exist or used solely to create email boxes will also not be accepted.
Their complete and current address optionally.

Failure to comply with the rules above jeopardizes the integrity of our services and may result in blocking and/or banning the user from the platform.

For what purpose can the platform be used. Accesses, queries, copies and downloads of any content from the site, whether free or paid, can be made with the intention of learning or teaching the content. The use of the platform for the creation of parallel databases is prohibited, whether they are private, shared, public, paid or free.

How often can the platform be used. The user is free to use the platform as often as they wish.

Non-compliance. Any activity carried out that is not consistent with these premises may be blocked and the user banned from the system.

HOW TO MODIFY AND CANCEL OUR SERVICES

The contract signed with D-Fit is for an indefinite period, and can be canceled at any time without additional costs. To cancel, simply click the MANAGE SUBSCRIPTION link on the My Account page, available at https://D-Fit.bio.br/my-account . Remember that after cancellation, it will be necessary to subscribe again to access Premium content.

The value of the contracted plan will be charged regardless of how many days are used.

CHANGES TO THE PLATFORM

We are constantly changing and improving our Services. We may include or remove functionalities or features and we may also suspend or terminate a Service completely. You can stop using our Services at any time. D-Fit may also stop providing the Services, include or create new limits to our Services at any time. We believe that you own your data and that it is important to preserve your access to that data.

OUR GUARANTEES AND DISCLAIMERS

We provide our Services using a commercially reasonable level of skill and care and we hope you enjoy using them. But there are some things we don't promise about our Services. Except when expressly provided in these terms or in additional terms, neither D-Fit nor its suppliers or distributors offer any warranties about the services or their continuity. For example, we are not responsible for the content in the services, for specific service features, or for the reliability, availability or ability to meet your needs. We provide the services "as is".

ETHICAL STANCE AND COMPLIANCE

Under no circumstances do the materials compiled and made available on this platform by professionals or students aim to or have the power to replace qualified professionals in the exercise of their profession. Therefore they do not serve to guide, advise or replace the exclusive attributes of Teachers. None of the data collected, made available or published by users will be used to capture clientele for the D-Fit Team. All and any disclosure of the material will be previously authorized by the Author, reviewed by the team and disclosed among the end users.

PLANS AND CONSUMPTION

D-Fit does not commit to adapt the plans, functionalities or tools of its services to meet specific objectives or achieve results defined by the USER. The functionalities and tools of D-Fit available to the USER are linked to their service registration account and are non-transferable.

No type of waiting period applies to the plans. The USER may change the plan they subscribe to at any time during the term of the relationship. a) In the event that the USER chooses to subscribe to a plan of higher value than the current plan at the time of the change, the availability of the tools and functionalities of the new plan is immediate; b) In the event that the USER chooses to subscribe to a plan of lower value than the current plan at the time of the change, the availability of the tools and functionalities will remain unchanged until the end of the current billing cycle. The functionalities and tools of the new contracted plan will be available from the beginning of the next billing cycle. Once the change of plans or packages has been made, a new change will only be possible: (i) to a plan of higher value; (ii) when the current billing cycle has been completed.

The functionalities, tools of D-Fit and consumption limits available to the USER are not cumulative and are reset every day. The plans and packages are not cumulative; only one plan can be contracted for each account registered on the platforms operated by D-Fit. The subscription plans are for an indefinite period, and can be unilaterally terminated without consent or compensation by either party. In addition to the modifications or changes mentioned in the previous item, D-Fit also reserves the right to unilaterally adjust the values of new packages or plans.

The provision of the service is subject to acceptance by the USER of D-Fit's terms of use. If you do not agree with any changes or modifications to this instrument or to any other term or policy of the services operated or maintained by D-Fit, the USER may choose to interrupt the provision of the service without refund of values that have already been paid.

BILLING AND PAYMENTS

The provisions of this section govern the payments, refunds and other transactions carried out between the parties resulting from the contracting, use and payment. Only payments made through the means chosen by D-Fit for this purpose will be accepted, and transactions carried out by other methods are null. The USER may choose any of the indicated payment methods at any time during the term of the relationship. Billing by credit card will be in the form of indivisible cycles of 30 (thirty) days from the date of contracting; the due date will always be the one coinciding with the anniversary in 30 (thirty) day cycles of the contracting.

In the event of cancellation of the service by the USER, the availability of the tools and functionalities will continue until the end of the cycle. If the USER provides credit card information for payment of the amounts for the use of D-Fit, the USER affirms and guarantees that they are authorized to provide such information and hereby authorizes D-Fit to use this data to charge the respective credit card for the payment of the amounts due.

REPENTANCE

If the relationship between the parties is consumerist, the USER is guaranteed the right of repentance for 7 (seven) days , under the terms of art. 49 of the Consumer Defense Code.

REFUND REQUEST

If for any reason you were unable to use D-Fit services, you can request a refund for your subscription. The request must be made using the CONTACT form on the own site, justifying and proving the existing problem.

VALUES AND ADJUSTMENTS

D-Fit may charge for access to specific resources (Premium). These values, when in the form of subscriptions with recurring billing, may be adjusted without prior notice to users.

If for any reason D-Fit needs to make value adjustments due to increases in operational costs, tax variations, implementation of new features and/or other relevant reasons, all users will be notified by email with at least 30 days in advance, so that they are aware of the changes and, if they wish, can cancel their subscriptions in time. All users who do not cancel their subscriptions after the notification will have their subscription values automatically adjusted after 30 days.

NON-COMPLIANCE WITH THESE TERMS

If any of the items present in these terms are not complied with by an individual, company, device, email, domain or IP, it is reserved to us the right of immediate, compulsory cancellation without prior notice of the provision of services, whether paid or free, as well as the blocking of access coming from the individual, company, device, domain, email, IP or any other source direct or indirectly linked to you, temporarily or permanently.

It is the user's responsibility to comply with all agreed clauses in these terms to avoid cancellation or blocking of the service.

ABOUT THESE TERMS

If you do not agree with the changed terms of a Service, you should discontinue the use of that Service.

In case of conflict between these terms and the additional terms, the additional terms will prevail with respect to that conflict. These terms govern the relationship between D-Fit and you. They do not create any rights for third parties. If you do not comply with these terms and we do not take immediate action, this does not mean that we are waiving any rights that we may have (such as taking future actions). If a specific condition of these terms is not enforceable, this will not affect any other terms.

VIOLATIONS OF THE TERMS OF USE

The USER may only access the products and services for lawful purposes. The USER is fully responsible for knowledge and adherence to any and all laws, regulations and rules pertinent to the use of the products and services covered by this term. If the contractual termination occurs due to non-compliance or violation by the USER of the provisions of this term, as well as non-compliance or violation of applicable legislation, no refund of amounts already paid will be due.

The USER may not reproduce, distribute, transmit, display, sell, license, alienate in any way or exploit any content accessed on D-Fit for any purposes, onerous or not. In the event of any measure, whether judicial or not, taken by third parties against D-Fit due to any content posted, publicized or otherwise made available by the USER in the services, D-Fit may turn such measure against the USER.

Any attempt to circumvent the rules of this term, such as, but not limited to, the use of false or incomplete registration information, the use of plugins or debug tools or source code inspection, attempt at reverse engineering or alteration of the source code, use of tools or plugins that modify the standard functionalities of the browser or site, use of automated or semi-automated access tools, attempts to copy, print, access, export or use the services differently from the functionalities already provided by the system or identification of repetitive usage patterns that may signal use outside the normal platform pattern, constitute threats to these terms of use and sufficient reasons for definitive exclusion and banning of the user from the platform and/or implementation of limitations on resources that the user has access to on the platform, both for paid plans as well as free.

We may contact you to request additional information about your registration, with the objective of guaranteeing the integrity of the platform. Failure to comply with such request or the provision of false or incomplete information constitutes a violation of the terms of use and may result in immediate and definitive cancellation of the contract, whether free or paid, and indefinite ban of the user from the platform without prior notice.

FINAL PROVISIONS

D-Fit may change this term at any time, without the need for prior notice.

D-Fit is not responsible for the availability or accuracy of the content or resources expected by the user.

D-Fit does not check the data or content entered by the USER, it is up to the USER themselves to verify the regularity of this information with the competent authorities, as well as other sources that can serve as a means of attesting to the veracity and copyrights of the same. In this case, D-Fit reserves the right to terminate the subscription in the event of knowledge of the falsehood or bad faith employed by the USER, and may prevent their subsequent return to the services offered, without the right to any type of compensation. The termination will be previously communicated to the USER.

Although D-Fit pursues perfection and excellence in the services it provides, it cannot guarantee:
(i) that it will meet specific expectations or results,
(ii) that it is interruption-proof, inviolable or error-proof,
(iii) that every detected error will be resolved, or
(iv) that the resolution will meet any USER expectations;
(v) that the content is 100% updated with the most recent research.

D-Fit will not be held responsible for any damage that may occur as a result of alteration, suspension or temporary discontinuation of any of its services.

BY REGISTERING ON THE PLATFORM THE USER DECLARES TO HAVE READ AND UNDERSTOOD THE TERMS AND PROVISIONS OF THIS USAGE AGREEMENT AND THAT IS AWARE OF ITS ENTIRE CONTENT, ACCEPTING ALL ITS CONDITIONS.
